Terms of service

These terms (version 2026-09-24-draft.3) are an agreement between you and arky (“we”), the operator named in the legal notice. They include the documents they link to: the risk disclosures, the prediction market terms, the acceptable use policy, the fees and the affiliate programme. The privacy policy explains how we handle personal data.

You accept these terms when you tick the box arky shows a connected wallet (in the getting-started guide, or on its own when the terms change). arky records that acceptance in your browser, against your wallet address and this version. If you do not accept them, do not use arky.

1. What arky is

arky is a software interface to smart contracts on the Arc network. Through it you can buy and sell memecoins (including ones launched by other users), launch a token, take positions in prediction markets, follow wallets, and use Scout, an AI agent.

arky is self-custodial. The wallet arky can create for you is generated in your browser and stored there, encrypted; its keys are never sent to us. You can also connect a wallet you already have. We cannot see, recover or reset your keys. If you lose your recovery phrase, nobody — including us — can restore your wallet.

arky is not a bank, broker, exchange, investment adviser or custodian of your wallet. Trades settle on-chain between your wallet and the contracts; we do not hold your wallet’s funds and are not your counterparty.

2. Testnet and mainnet

arky currently runs on the Arc testnet. Tokens, test USDC and positions on the testnet have no monetary value. Testnet state may be reset, and features may change or stop without notice. Before arky runs on Arc mainnet with real funds, these terms will be reviewed by a lawyer and published as a new version, which you will be asked to accept.

3. Who may use arky

  • You must be at least 18 years old and able to enter into a binding agreement.
  • You must not be, or act for, a person or entity on a sanctions list, including the U.S. Treasury’s Specially Designated Nationals (SDN) list. arky screens wallet addresses against that list; see the acceptable use policy.
  • You are responsible for making sure that using arky is lawful where you live and where you are. arky does not block access by location, and its availability in a country does not mean it is lawful there.

4. Your wallet and your transactions

  • You are responsible for your recovery phrase, your device and every transaction your wallet signs.
  • Blockchain transactions are final. Once confirmed, we cannot reverse, cancel or refund them.
  • Prices move between the moment you see a quote and the moment your transaction confirms. You choose the slippage you accept.
  • Network fees and trading fees apply; the fee for a trade is shown before you confirm it.

5. Fees

Trades pay a fee set in the smart contracts. The current fee and its split between the token’s creator, the person who referred you (if any) and arky are read live from the chain on the fees page. The contract applies the fee in force when your trade executes.

6. Tokens and markets created by users

Anyone can launch a token or create a prediction market through arky. We do not review, endorse or vouch for them. Names, images and descriptions are supplied by their creators, who are responsible for them and who grant the licence described in the intellectual property page. Do your own research.

7. Scout, the AI agent

Scout proposes, your wallet signs. In chat, Scout answers questions and can propose a trade that you review and sign in your own wallet; nothing happens until you sign. Proposals are limited in size and expire if you do not sign them, and Scout checks on-chain that a trade you report as done really happened.

Autopilot is off unless you turn it on. If you create and fund an agent vault and switch autopilot on, Scout can trade the funds in that vault without asking you first, but only within the per-trade and daily limits recorded in the vault’s contract, and it asks for your confirmation above the amount you set. You can pause Scout, turn autopilot off, withdraw from the vault or revoke it at any time.

Scout does not search or browse the internet. It answers only from arky’s live data, prices and your own history on arky. Scout remembers facts about you only when you ask it to, and forgets them when you ask (see the privacy policy).

Scout is a language model and can be wrong. Its output is not advice. You remain responsible for the trades you sign and for what Scout does within the limits you gave it.

8. Rules of use

You must follow the acceptable use policy. We may restrict or end your access to the interface if you break these terms or where the law requires it. Because arky is self-custodial, doing so never gives us your funds.

9. No advice

Nothing on arky — prices, charts, rankings, market odds, Scout’s replies — is investment, financial, legal or tax advice, or a recommendation to buy or sell anything.

10. Service “as is”

arky is provided as is and as available. We do not promise it will be uninterrupted or error-free, or that the data it shows (from the blockchain and third-party sources) is complete or current. Smart contracts can have bugs; the contracts arky uses have not had an external security audit.

11. Liability

To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, or losses caused by market movements, your own mistakes, blockchain or network failures, third-party services, or smart contract behaviour. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer under mandatory law.

12. Changes

We may update these terms. Each version has a date-based identifier (shown at the top). When it changes, arky asks your wallet to accept the new version before you continue.
