1. arky’s own material

The arky name, logo, interface and texts belong to arky or its licensors. You may use arky for its purpose; you may not copy or reuse them otherwise without permission. The smart contracts are published under the licence stated in each source file.

2. What you upload

When you launch a token or create a market, you supply its name, ticker, description and picture. You keep your rights in them. By uploading, you confirm that you own them or may use them, and you give arky a worldwide, free, non-exclusive licence to store, copy, resize and display them for as long as the token or market is shown in arky.

Pictures are PNG, JPEG, GIF or WebP, square, at most 4 MB and 4096 pixels a side. They are stored by our hosting provider under a name derived from their content, and anyone can view them. arky does not review uploads before they are published. A token’s name and ticker are also written on-chain, where we cannot change them.

3. Reporting an infringement

If you believe a token, market or picture shown in arky infringes your copyright, trademark or other rights, or is otherwise unlawful, send a notice to [to be completed: takedown notice email] with:

  1. your name and contact details;
  2. the work or right you say is infringed, and proof that it is yours or that you act for its owner;
  3. where it appears in arky (the page address, or the token or market address);
  4. why it infringes, and, for unlawful content, the law you rely on;
  5. a statement that the information is accurate and made in good faith, and your signature.

This notice meets the requirements of the EU Digital Services Act and French law (LCEN), and of the U.S. Digital Millennium Copyright Act for copyright. [to be completed: DMCA designated agent registration, if arky targets the United States]

4. What we do

  • We acknowledge a complete notice and review it promptly.
  • If it is well founded, we remove the picture from our storage and stop showing the token’s or market’s content in arky’s interface. We cannot remove anything from the blockchain. [to be completed: the tool to hide a token or market in the interface does not exist yet]
  • We tell the uploader where we can reach them, and give them the reasons.
  • We may restrict the access of anyone who repeatedly uploads infringing content.

5. Counter-notice

If your content was removed and you believe that was a mistake, write to the same address with your details, what was removed, and why you have the right to use it. We will review it and may restore the content.

Knowingly false notices or counter-notices can make their author liable. See also the acceptable use policy.
