Acceptable use and jurisdictions

This policy is part of the terms of service. It applies to everything you do through arky: trading, launching tokens, creating markets, uploading images, referring people and using Scout.

1. Where you use arky

arky does not block access by country or region. That is not a statement that arky is lawful everywhere. Laws on crypto-assets, memecoins and prediction markets differ from country to country and change often. You are responsible for checking and following the law that applies to you, including licensing, gambling, securities, consumer and tax rules. If using arky, or any part of it, is not lawful for you, do not use it.

2. Sanctions

You may not use arky if you are, or act for or on behalf of, a person or entity designated on a sanctions list, including the U.S. Treasury’s Specially Designated Nationals (SDN) list, or if the use would breach sanctions that apply to you or to us.

How arky screens wallets

  • arky screens wallet addresses against the Ethereum-format addresses published in OFAC’s SDN list. The list ships with the app and is refreshed from the U.S. Treasury once a day.
  • A listed wallet cannot sign in to arky or to Scout, and a session opened before a wallet was listed stops working.
  • Before arky asks your wallet to sign a trade, bet, token launch, market creation, claim, send or cross-chain transfer, it checks the signing wallet, and for sends and transfers the receiving address too. A listed address is refused before any signature is requested.
  • If the screening service is briefly unreachable, trades placed through the app go ahead without the check; sign-in and session screening never switch off.
  • arky does not keep a record of which addresses were screened; it counts refusals only. Screening covers the OFAC SDN list only, not EU, UK or UN lists.
  • The smart contracts themselves do not screen: this is a control on arky’s own interface.

Do not try to get around the screening, for example by routing funds through another wallet or by calling the contracts on someone else’s behalf.

3. What you must not do

  • break any law, including anti-money-laundering, sanctions, fraud and market-manipulation laws;
  • manipulate prices or markets: wash trading, spoofing, coordinated pumps, or trading on a market whose outcome you control or can influence;
  • launch a token or create a market that is fraudulent or misleading, or that impersonates a person, brand or project;
  • upload or publish anything you have no right to use, or that is illegal, sexual content involving minors, hateful, harassing, or that incites violence (see intellectual property);
  • create markets on death, violence, terrorism or a private person’s life;
  • game the affiliate programme, for example by referring yourself or trading against your own referrals;
  • attack, overload or probe the service, get around its rate limits, scrape it at scale, or interfere with other users;
  • use Scout to do any of the above, to gather personal information about other people, or to try to make it act outside the limits you or we set (for example by planting instructions in your messages or in its memory).

4. What we may do

If you break this policy, we may hide your tokens, markets or images in arky’s interface, hold or cancel affiliate rewards, and restrict your access to the interface. We may report illegal activity to the authorities. What is on the blockchain stays there: we cannot delete it.
